By using mojcabs website or downloading mojcabs app you agree to terms of use, privacy policy and cancellation policy.The content of the pages of this website is for your general information and use only. It is subject to change without prior notice. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. Unauthorized use of mojcabs website or any app of mojcabs may give rise to a claim for damages and/or be a criminal offense.
Terms and conditions
After successfully booking trip, OTP will be shown in app for starting trip and sometimes for ending trip.
Producing the OTP provided earlier is mandatory to avail the car rental services by Mojcabs..If this is not done it entitles the driver to refuse service delivery without any liability on us to refund the booking amount.
When a customer produces the OTP provided to him it earlier, it implies that he have read and understood all terms and conditions mentioned herewith and agrees on all of them.
By providing OTP to driver you authorize driver to start or end trip.
You shall provide Start Trip OTP only after driver arrives at your location and you are seated in same vehicle as mentioned in the app.
For distance based trip you must give Start Trip OTP only after checking Start Odometer reading driver enters in his app.
For distance based trips you must give End Trip OTP only after checking End Odometer reading driver enters in his app. If you have any dispute or query regarding distance you must talk to customer care before giving End Trip OTP to driver.
Parking charges, toll charges, state taxes and entry fees, will be mentioned in app and must be paid by customer if they are applicable. Any additional parking charges, entry fees etc. must be paid by customer.
Unless specified otherwise, all meter readings/distances/timings will be calculated to and fro from point of pick-up to point of destination
Distances between two locations mentioned anywhere in app or website are approximate. Actual distance may differ. Customer will be liable to pay extra distance charges for distance based trips.
Car air-conditioner will be turned off on hilly routes and also when the vehicle is not in motion. The customer is also not expected to request driver to make the air condition operational in afore mentioned cases.
Any form of discounts are only applicable only on the basic fare and cannot be made available on extra charges like toll, taxes, charges on for extra kms consumed if applicable, charges for extra hours consumed if applicable, driver allowance, parking, night charges, unless specified.
For shared trips you must book seat for every passenger above age of 5, no pets will be allowed.
Driver may cancel your trip in conditions like misbehavior with other passengers or driver, smoking, or being drunk, or unappropriated attire, or consuming tobacco.
For shared trips you agree to share vehicle with other passengers, and respect other passengers.
For shared trips there will be limit of maximum luggage allowed, this limit will be mentioned in app during booking, this limit must be followed by you, driver may cancel the trip if this limit is violated. Only small bags such as carry bags, laptop bags, handbags are allowed.
For shared trip driver will call you after arriving at pickup point, and will wait maximum 15 minutes for you to reach at pickup point. After waiting for 15 minutes driver may choose to cancel your trip.
For shared trip multiple passengers will be picked up and dropped by driver. The order of pickup and drop of passengers will be suggested by app but final decision will be left to driver.
Shared trip packages have a car use ratio which is ratio between number of passengers vehicle will be shared with and number of seats available in the vehicle. The segment of vehicle provided can differ(as long as car use ratio is same or lower) from segment of vehicle mentioned in plan during booking, depending on availability of vehicles.
The vehicle booked will be subject to availability. In a case where the car booked is not available on the day of travel the customer will be provided with an alternative equivalent vehicle in the similar segment as applicable.
We don’t guarantee to provide vehicle, or to complete service, we shall not be held responsible for any damage or loss incurred due to this.
For outstation trips driver requires at least 1 hour for servicing the car and some additional time to reach at pickup location, by booking outstation trip you agree that you are aware of this and have accounted for additional time required by driver.
For any trip, driver will drive the car only in areas which are suitable for car and safe for car, driver and passengers.
In case of any accident / injury before, during or after trip mojcabs is not liable to pay any amount.
Customer is responsilbe for checking expiry of car Insurance, car fitness and permit certificate, mojcabs will not be liable to pay any charges, incured due to damage/death caused to passenger or their luggage or anyone, due to expiry or absense of documents. In such cases customer can report to us before starting trip and appropriate actions may be taken by mojcabs.
Customer is liable to pay for any additional distance traveled and also for additional hourly charges if applicable. Any unscheduled changes will attract additional charges as applicable.
For distance based trips, fare of minimum 300 kms for SUV, 250 kms for hatch back, 250 kms for sedan, will be charged for each calendar day even if car travels less than that.
For outstation private and airport private trips, only stops are pickup and drop, no additional stops will be provided, for additional stops you must book round trip,
Mojcabs cannot be hold accountable for any delay or consequential loss caused to the customer due to traffic jam or reasons beyond reasonable control of the driver or lapses on the part of the driver.
Mojcabs cannot be hold accountable for any loss, damage, physical injury etc suffered by the customer while availing its services.
Customer must provide PNR number to support staff for availing any help related to trip.
In case of any dispute parties agree to the exclusive jurisdiction of courts of Ahmedabad, Gujarat.
In addition to all the above-mentioned terms & conditions, cancellation policy is applicable.
We are not liable for any damage caused due to accident.
We are not liable for any loss caused due to missing flight/train/bus/meeting/conference etc.
Payments and Security
Payment processing is handled by razor pay, which is leading payment provider of India and uses best security standards, no payment related information is stored at our end,
Special Instructions:
Driver & Car details – will be shown in app, also start trip and end trip otp will be shown in app.
In case driver is not assigned to trip you must call mojcabs..and provide pnr number.
Payment of extra charges - Any extra charges applicable has to be paid directly in cash to the driver.
Refusal by the driver to deliver services - The customer to contact the support of mojcabs.
It is expressly made clear to you hereby that Mojcabs does not own any taxis nor does it directly or indirectly employ any drivers for the vehicles. Vehicles are owned by operators who authorize driver to driver their car, and mojcabs disclaims any and all liability in respect of the drivers and the vehicles alike.
The Customer shall indemnify Mojcabs from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnity basis) claims, demands, actions and proceedings which Mojcabs may incur or sustain directly or indirectly from or by any reason of or in relation to the use or proposed use of the Services by the Customer and shall pay such sums on demand on Mojcabs.
Mojcabs shall be entitled at any time without giving any reason to terminate the booking of cabs done by the Customer.
Mojcabs does not assure a complete sustainability of its Service and shall not be held responsible or liable for the same, in any manner.
Mojcabs shall endeavor to respond to your issues within a reasonable time of your reporting the same and endeavor to resolve it at the earliest possible. It is hereby clarified that issues are resolved on severity basis, and certain may be resolved earlier than the other. However, Mojcabs shall not be liable for any damages or losses in the event that you are not satisfied with any such resolution.
IN ADDITION, AND WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Mojcab’s AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE USER TERMS OR THE SERVICES RENDERED HEREUNDER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY, OR OTHER THEORY), WARRANTY, OR OTHERWISE, EXCEED THE AMOUNT OF Rs. 400/- (Rupees Four Hundred only)
